The position of consumer organisations in civil court proceedings

Jurisprudence 4/2022 Section: Articles Page: 1-7

Keywords: consumer organisation, consumer, civil procedure, costs, intervention, representation

Abstract: In this article I discuss the current state of the legal regulation of consumer organisations taking part in civil court proceedings, and I consider the possibilities of future legislation in this area. I focus on the standing of a consumer organisation to file a lawsuit, to act as an intervener in the proceedings. Furthermore, I deal with variants of consumers being represented in court proceedings. I also consider the issue of representative actions under Directive (EU) 2020/1828 of the European Parliament and of the Council and third-party financing of court proceedings.
