The Course of Procedure and Presenting of Evidence in Special Judicial Proceedings

Abstract: On January 1st, 2014 the new procedural norm that governs the so called special judicial procedure (Act No. 292/2013 Coll., on special judicial proceedings) came into effect. This regulation aims to be the code of the non-disputed proceedings, meaning that it defines its own general procedural principles that distinguish undisputed procedure from the disputed. On the other hand, the new code states, that in case of special proceedings, the Code of Civil Procedure should be applied. It also introduces new concepts that have not yet been a part of the Czech civil procedure (eg the special judicial year). The author attempts to describe the basic rules of the new Code and on its basis to assesswhether this new law will actually benefit the civil procedure.
