Abstract: The article analyses the judgment of the Court of Justice of the EU declaring the Czech rule prohibiting the membership of foreigners in Czech political parties and movements to be incompatible with the rules for EU citizenship (C-808/21 European Commission versus Czech Republic). This judgment is further contextualised within the older case law on EU citizenship and the Czech legislative reaction to the judgement.
