Ultra vires doubts regarding the CJEU judgement on the sale of Maltese citizenship

Abstract: The article critically reacts to recent judgement C-181/23, where the EU Court of Justice found the Maltese scheme of investment sale of Maltese citizenship and with it EU citizenship to infringe EU Law. It is pointed out in the article that the judgement raises certain ultra vires doubts and is an example of the competence creep by the EU Court. It is argued in the article that the Court could have possibly avoided such doubts if it had employed the EU doctrine and principle of abuse of EU Law.
