Abstract: The presented article deals with the relationship between the new Act on Collective Proceedings and the Code of Civil Procedure, through the lens of the basic procedural subjects acting in collective proceedings. It examines to what extent the Code of Civil Procedure applies to the role, as well as the rights and obligations of the procedural subjects and where the most significant differences lie. Attention is paid to the position of the court, as well as the position of the plaintiff and the defendant in collective proceedings. The article also discusses other actors that may be encountered in ordinary civil court proceedings or, on the contrary, exclusively in class actions.
