Certain Ethical Aspects of Using Artificial Intelligence in Justifying Court Decisions

Abstract: Some aspects of the use of artificial intelligence in the judiciary have already been addressed by certain authors. However, no one has yet examined its use from the perspective of professional ethics. This article thus helps to fill one of the gaps in the current professional discourse by exploring the compatibility of using artificial intelligence tools in the reasoning of judicial decisions with the rules of professional ethics for judges. It concludes that while the use of these tools can significantly assist judges in their work, the reasoning of judicial decisions should not be entirely left to these tools. The element of human oversight and the open acknowledgment in the decision that artificial intelligence has assisted in its writing are not only an ethical requirement for Czech judges but also a legal obligation.
