Membership of Judges in a Political Party and Church

Abstract: In the beginning, the article shortly introduces to readers the basic terms – independence and impartiality of judges. Consequently, it proceeds to analyzing the membership of judges in political parties and emphasizes the amendment of the Courts and Judges Act that includes a prohibition of membership of judges in political parties, and the arguments presented by the legislation. The author concludes that the membership of judges in political parties should not be forbidden. In the second part, the author focuses on the membership of judges in a church. In connection to nearly absent membership rules in five examined churches, the membership in these subjects does not seem to raise doubts on a breach of the independence and impartiality of judges.
