Human rights in Asia: The evolution of human rights protection in ASEAN

Jurisprudence 5/2023 Section: Articles Page: 43-48

Keywords: ASEAN, human rights, system of human rights protection

Abstract: At present, Asia remains one of the few regions in the world that has not developed its own human rights protection system to promote and protect human rights. A certain change in this area is represented by the efforts of the ASEAN subregional organisation to create a human rights protection system within this organisation. The aim of this contribution is to outline the approach to human protection in ASEAN over the last 30 years or so and to examine the structure of the system, in particular its human rights bodies and documents adopted within its framework for the protection and promotion of human rights. Subsequently, the text examines how the protection provided by these tools is effective and what possible shortcomings it contains. A special section is devoted to a comparison of how ASEAN balances the sovereignty of its member states, which is essential for them together with the principle of non-interference in the internal affairs of another state, and human rights.
