Lustration and the course of time or (how long) can Czech screening laws still survive?
David Kosař
The lustration laws have represented and still represent for Czech courts, and by extension also for the rule of law in the Czech Republic, one of the biggest challenges within the framework of the transition process towards democracy. Although both these Acts on lustration from 1991 and 1992 were originally adopted for the period of five years only, in 2008 they still remain a part of the legal order in force. And not only that, the lustration acts still stir emotions and political controversies. Thus just recently we have been witnesses to the scandalous affairs related with the names of Jaromír Nohavica, Josef Tošenovský and František Lambert. In my view, these three cases have not only attracted (again) the attention of media to the problems related with getting even with the past, but also (again) have pointed to the evident shortcomings of Czech lustration laws themselves.
